Terms & Conditions
Effective Date: March 9, 2026
These Terms & Conditions govern the relationship between Amakuna Travel LLC (“Amakuna”, “we”, “us”, “our”) and the traveler or client (“Client”, “you”, “your”) booking travel services through Amakuna. Amakuna Travel LLC is a limited liability company organized under the laws of the State of Wyoming.
1. Role of Amakuna Travel
Amakuna Travel LLC designs and arranges bespoke travel experiences and itineraries in Colombia. With deep local knowledge and established relationships with carefully selected suppliers, Amakuna curates and coordinates each element of the client’s journey.
Amakuna acts as a travel designer, coordinator, and seller of travel services. The travel services included in Amakuna itineraries — including accommodations, transportation, guided experiences, dining, and activities — are ultimately provided by independent third-party suppliers such as:
- hotels and lodges
- airlines and charter flights
- transportation providers
- guides and activity operators
- restaurants and experience providers
- destination management companies
While Amakuna selects and coordinates these suppliers with care, each operates independently and is not an employee, agent, joint venturer, or representative of Amakuna Travel LLC. Clients may also be subject to the separate terms and conditions of those suppliers, which are incorporated by reference into this agreement.
Amakuna shall not be liable for the acts, omissions, negligence, insolvency, bankruptcy, or financial failure of any independent supplier. All transportation, guiding, activity, and other travel services are operated by independent third-party suppliers who are solely responsible for the operation and safety of their services, equipment, vehicles, vessels, and personnel.
2. Retainer Engagement and Contract Formation
All bookings must be made by a person aged eighteen (18) years or over.
Retainer Engagement. Upon payment of the Retainer Fee (see Section 3), Amakuna will commence itinerary research, design, and consultation on behalf of the Client. The Retainer Fee engages Amakuna’s design services only and does not constitute a booking or contract for travel services.
Contract Formation. A binding contract for travel services between the Client and Amakuna Travel LLC is formed when:
- The Client approves the proposed final itinerary;
- Amakuna issues a Booking Confirmation and deposit invoice (or full trip invoice where departure falls within 60 days); and
- The Client pays the required deposit or full trip payment.
The Booking Confirmation, Final Itinerary, and these Terms & Conditions constitute the full contract between the parties. In the event of any inconsistency between documents, the following order of precedence shall apply:
- Booking Confirmation / Invoice
- Final Itinerary
- These Terms & Conditions
- Supplier terms incorporated by reference
Marketing materials, website content, or proposals not expressly included in the Booking Confirmation are illustrative only and not contractual.
3. Retainer Fees
Amakuna charges a non-refundable Retainer Fee for the design and planning of bespoke itineraries. The standard Retainer Fee is $250, though higher fees may apply depending on itinerary complexity. Retainer Fees are non-refundable and separate from trip costs unless explicitly stated otherwise.
4. Payment Terms
A deposit, typically 50% of the trip price, is required to confirm reservations. The remaining balance must be paid 60 days prior to departure, unless otherwise specified. Certain suppliers may require higher deposits or full prepayment, particularly for festive season travel, private villas, charter services, boutique properties, or special events. Failure to make payments by the stated deadlines may result in cancellation of the booking and the application of cancellation penalties.
Payments may be made via:
- credit card (including American Express)
- bank transfer
- other approved methods
Clients are responsible for bank fees and currency conversion costs. Where credit cards are used, the Client authorizes Amakuna to charge the card on file for scheduled payments.
Clients agree not to initiate credit card chargebacks without first contacting Amakuna to attempt resolution. Improper chargebacks may result in recovery actions and liability for bank fees, processor fees, administrative costs, and reasonable legal expenses.
5. Pricing
All prices are quoted in US Dollars (USD) unless otherwise specified. Trip prices may change prior to confirmation due to supplier price changes, exchange rate fluctuations, fuel surcharges, or government taxes. After confirmation, prices are generally guaranteed except where increases are imposed by suppliers or authorities beyond Amakuna’s control.
6. Included Services
The Booking Confirmation and Final Itinerary specify services included in the trip. These may include accommodations, transportation, guided experiences, meals, and other services as listed.
7. Exclusions
Unless explicitly stated, prices do not include:
- international airfare
- travel insurance
- visas or entry fees
- personal expenses
- gratuities
- optional activities not listed in the itinerary
8. Special Requests
Amakuna will always communicate special requests — including preferences for room type, bedding, dietary requirements, guides, vehicles, early check-in, or late check-out — to the relevant suppliers. However, fulfillment depends on supplier availability and such requests cannot be guaranteed unless expressly confirmed by Amakuna in writing.
9. Lead Name and Group Bookings
Where a booking is made for more than one person, the first-named adult (18 years or over) will be treated as the “Lead Name” for the booking.
The Lead Name is responsible for:
- making all payments due to Amakuna
- communicating changes or cancellations on behalf of all travelers in the party
- ensuring all members of the party are aware of and agree to these Terms & Conditions
Unless otherwise agreed in writing, Amakuna will communicate solely with the Lead Name.
10. Changes or Cancellation by the Client
All requests to change or cancel confirmed bookings must be submitted in writing. For group bookings, changes and cancellations must be authorized by the Lead Name.
Changes to Confirmed Bookings
Amakuna will attempt to accommodate requested changes but cannot guarantee availability. Changes may include alterations to dates, routing, accommodations, activities, the number of travelers, or the duration of the trip.
An administration fee of $100 per person applies to change requests received 60 days or more prior to departure, and $200 per person for requests received less than 60 days prior to departure. Administration fees are non-refundable.
In addition to administration fees, the Client is responsible for any supplier change penalties, fare or rate differences, and price adjustments resulting from the requested change. Many suppliers — particularly airlines, boutique properties, and charter operators — do not permit changes and may impose full cancellation charges. These charges will be passed through to the Client. The Client is responsible for any non-recoverable costs incurred by Amakuna as a result of a requested change, reduction in party size, or partial cancellation.
Where a change results in a material increase to the per-person cost (for example, due to fixed costs being shared among fewer travelers), the revised pricing will be communicated to the Client before the change is confirmed. The Client may accept the revised pricing or retain the original booking unchanged.
Reduction in Party Size
Where one or more travelers are removed from a group booking, this constitutes a partial cancellation. The cancellation schedule below applies on a per-person basis to each removed traveler, calculated against that traveler’s share of the total trip price.
The remaining travelers’ itinerary will be re-priced to reflect the reduced party size. Even where the itinerary itself remains unchanged, pricing may increase as fixed costs — including but not limited to private vehicles, guides, villa or property minimums, and charter services — may not decrease proportionally with group size.
Certain suppliers impose minimum participation or occupancy thresholds. If a reduction in party size causes the booking to fall below a supplier’s minimum, the affected service may need to be revised, substituted, or removed, and pricing will be adjusted accordingly.
Deposits paid are not transferable between travelers or reallocable against a reduced booking unless expressly agreed by Amakuna in writing.
Removal of Activities or Services
Where the Client requests the removal of specific activities, experiences, or services from a confirmed itinerary, this constitutes a partial cancellation of those services. Refunds for removed services are subject to supplier cancellation policies, which may result in no refund or a partial refund only.
Amakuna is not obligated to provide a refund or credit for removed services where supplier costs have already been committed or are non-recoverable. An administration fee may also apply.
Reduction in Trip Duration
Where the Client requests a reduction in the number of days or nights in a confirmed itinerary, this constitutes a partial cancellation of the affected dates. Supplier cancellation policies apply to any accommodations, transportation, guides, or services associated with the removed dates.
Shortening a trip may also affect the pricing of remaining services. Certain supplier rates are based on minimum stay requirements or multi-day packages, and a reduction in duration may result in higher per-night or per-day rates for the remaining dates.
Cancellation of the Entire Booking
Cancellation penalties apply as follows:
| Time Before Departure | Cancellation Charge |
|---|---|
| 60 days or more | Deposit forfeited |
| 59–43 days | 60% of total price |
| 42–29 days | 75% of total price |
| 28–7 days | 90% of total price |
| 6 days or less | 100% of total price |
| No-show | 100% of total price |
Failure to appear at a departure point or first accommodation (“No-Show”) shall be treated as a cancellation on the date of departure and subject to a 100% cancellation charge.
Certain services may be fully non-refundable at the time of booking. Retainer Fees and administrative charges are always non-refundable. Any amounts recovered by Amakuna from suppliers following a cancellation are at Amakuna’s sole discretion and do not reduce or offset the cancellation charges set out above.
11. Booking Transfers
Where the Client or any member of the traveling party is prevented from traveling for any reason, the Client may request in writing that the booking be transferred to another person who satisfies all requirements relating to the itinerary.
Transfer requests must be received a reasonable time prior to departure. Transfers are subject to supplier approval and may incur administrative fees or charges imposed by suppliers. Any additional costs resulting from a transfer are the responsibility of the Client.
Amakuna cannot guarantee that transfers will be possible. Where a transfer cannot be accommodated, cancellation penalties as set out in Section 10 shall apply.
12. Changes by Amakuna
From time to time, it may be necessary to adjust elements of an itinerary due to operational requirements, supplier availability, safety considerations, or circumstances beyond our control. Where changes are needed, Amakuna will work to ensure the overall quality and character of the experience is maintained.
Minor changes include substitutions of specific guides, vehicles, restaurants, or activity times with comparable alternatives. Amakuna may make minor changes at any time and will notify the Client as soon as reasonably practicable.
Major changes include a change of accommodation to a materially different standard, a significant alteration to the destination or routing, or a change to departure dates. In the event of a major change before departure, the Client will have the option to:
- accept the change;
- transfer to an alternative itinerary of equivalent or superior quality (subject to availability); or
- cancel the booking and receive a full refund of all amounts paid to Amakuna (excluding Retainer Fees and non-refundable supplier costs already incurred).
Amakuna shall not be liable for additional costs, delays, or disruptions resulting from changes beyond its reasonable control.
13. Force Majeure
Amakuna shall not be liable for any delay, cancellation, or disruption caused by events beyond its reasonable control, including but not limited to:
- natural disasters, severe weather, volcanic activity, flood, fire, or storm
- pandemics, epidemics, or public health emergencies
- war, civil unrest, terrorism, or political instability
- government restrictions, regulatory actions, or travel advisories
- strikes, labor disputes, or industrial action
- airline cancellations, delays, or air traffic control failures
- equipment or infrastructure failure
- police or security alerts or precautionary measures
In such cases, refunds will depend on amounts recoverable from suppliers. Amakuna will use reasonable efforts to arrange comparable alternatives but is not obligated to do so.
14. Destination Risks
Travel to any destination involves a degree of inherent risk. While Amakuna maintains close familiarity with the destinations and conditions in Colombia, Clients are responsible for reviewing applicable government travel advisories and making their own informed decision about whether to travel. Amakuna does not guarantee the safety or suitability of any destination.
15. Remote Travel Conditions
Some itineraries include travel to remote or rural areas where infrastructure, communications, and medical facilities may be more limited than in major urban centers. This is often part of what makes these destinations extraordinary.
Medical services and evacuation providers in such areas operate independently and under their own professional judgment. Amakuna makes no representation regarding the availability or quality of such services but will assist in coordinating emergency support to the extent possible.
16. Client Responsibilities
Clients are responsible for ensuring they possess all required travel documents, including valid passports, visas, and vaccination certificates. Amakuna is not responsible for denied entry due to missing or invalid documentation.
Clients are responsible for ensuring that all personal information provided to Amakuna is accurate, including names, dates of birth, passport details, and contact information. Amakuna shall not be liable for any costs, delays, or disruptions arising from inaccurate information provided by the Client.
Clients must ensure they are medically fit for travel and must disclose any relevant health conditions that could affect their participation in the itinerary. Amakuna reserves the right to refuse participation where a traveler’s health presents a risk to themselves or others.
17. Traveler Conduct
Clients must comply with all local laws and supplier rules throughout the duration of travel.
Amakuna and its suppliers reserve the right to remove any traveler from services without refund if that traveler behaves in a dangerous, disruptive, unlawful, or abusive manner, or is under the influence of alcohol or drugs to a degree that compromises safety or the experience of other travelers.
No costs or expenses incurred as a result of such removal will be recoverable from Amakuna. The Client may also become subject to local law enforcement inquiry or prosecution.
18. Travel Insurance
Comprehensive travel insurance is a requirement for all Amakuna trips. Coverage should include trip cancellation, medical expenses, emergency evacuation, and travel interruption, and must be in place prior to departure.
Clients must ensure that all planned activities included in their itinerary are covered under their insurance policy. Credit card travel insurance may not provide adequate coverage and should be reviewed carefully.
Clients who decline insurance do so at their own risk and assume all financial risks associated with cancellations, medical emergencies, and travel disruptions. Amakuna shall not be liable for any losses that would have been covered by adequate insurance.
19. Assumption of Risk
Travel and certain activities may involve inherent risks including but not limited to:
- road conditions and vehicle travel in remote regions
- weather events and environmental conditions
- wildlife encounters
- uneven terrain
- water activities and boat transport
- altitude or climate variations
By participating in such activities, Clients voluntarily assume all associated risks. Clients may be required to sign waivers from third-party activity providers as a condition of participation.
20. Limitation of Liability
To the fullest extent permitted by law, Amakuna Travel LLC shall not be liable for acts or omissions of independent suppliers, airline delays or cancellations, weather events, government actions, strikes, or other force majeure circumstances.
Amakuna’s maximum liability shall not exceed the total amount paid by the Client to Amakuna for the services in question.
Amakuna shall not be liable for loss of enjoyment, emotional distress, lost profits, incidental damages, or consequential damages.
These limitations of liability are a fundamental basis of the agreement between the parties.
Nothing in these Terms shall limit or exclude Amakuna’s liability where such exclusion is not permitted under applicable law.
21. Indemnification
Clients agree to indemnify and hold harmless Amakuna Travel LLC and its employees, contractors, and affiliates from any claims, liabilities, damages, or expenses arising from the Client’s breach of these Terms, violation of laws, or negligent or reckless conduct during travel.
Amakuna reserves the right to assume exclusive defense of any claim subject to indemnification.
22. Data Protection
Amakuna collects and processes personal data solely for the purposes of administering bookings, delivering travel services, and communicating with Clients. This may include passport details, health information disclosed by the Client, payment information, and travel preferences.
Amakuna observes applicable data protection laws, including relevant United States federal and state privacy regulations. Further details are available in our Privacy Policy, available upon request or at www.amakuna.com.
23. Complaints and Claims
Any issues during travel must be reported immediately to the relevant supplier and to Amakuna’s emergency contact. Failure to notify Amakuna during the trip may affect the ability to resolve the issue.
Written complaints must be submitted within 28 days of return.
Any legal claim arising out of or related to the booking or travel services must be brought within one (1) year of the end of travel, or it shall be permanently barred.
24. Pre-Suit Notice
Before initiating arbitration or legal proceedings, the Client must provide written notice to Amakuna describing the claim and requested relief. The parties will attempt to resolve disputes informally for 30 days following such notice.
25. Dispute Resolution
Any unresolved dispute shall be resolved through binding arbitration conducted under the rules of the American Arbitration Association. Arbitration shall take place in Wyoming, USA.
Claims must be brought individually and not as part of any class action. Both parties waive the right to trial by jury to the fullest extent permitted by law.
26. Governing Law
These Terms & Conditions shall be governed by the laws of the State of Wyoming, USA.
27. Notices
Legal notices must be sent to:

28. Severability
If any provision of these Terms is found to be invalid or unenforceable by a court or arbitrator of competent jurisdiction, the remaining provisions shall remain in full force and effect.
29. Updates
These Terms & Conditions may be updated from time to time. The version in effect at the time of booking shall apply to that booking. The current version is available at www.amakuna.com.
30. Survival
Provisions regarding payment obligations, limitation of liability, indemnification, dispute resolution, data protection, and governing law shall survive termination of the contract.
31. Entire Agreement
These Terms & Conditions, together with the Booking Confirmation and Final Itinerary, constitute the entire agreement between the parties.
32. Acceptance
Payment of any invoice issued by Amakuna Travel LLC constitutes acceptance of these Terms & Conditions.
